The principle of equal pay for equal work or work of equal value in the case of workers with disabilities
Abstract: The rights of people with disabilities in relation to working conditions and employment are protected through legislative provisions, complemented by policy initiatives at the EU level. However, the well-established principle of equal pay for equal work or work of equal value, developed in relation to women and men, has not been extended in a comparable manner to workers with disabilities. Empirical evidence shows that people with disabilities are paid less than comparable workers without disabilities. This Article examines the current EU legal framework applicable to workers with disabilities, with particular emphasis on its capacity to address the disability pay gap. It further explores the possibility of extending the principle of equal pay, beyond the ground of gender, to include workers with disabilities.
