L’attuazione della Convenzione ONU sui diritti delle persone con disabilità in Trentino: bilancio e prospettive – Die Umsetzung der UN-Konvention über die Rechte von Menschen mit Behinderungen im Trentino: Bilanz und Perspektiven
Sinossi: Il saggio ricostruisce la (complessa) disciplina vigente in Trentino con riguardo alla tutela delle persone con disabilità, concentrandosi in particolare sulle ragioni per le quali a livello provinciale non è stato istituito un organismo di monitoraggio della relativa Convenzione ONU del 2006 (come invece avvenuto in Tirolo e in Alto Adige/Südtirol, ovvero negli altri territori dell’Euregio). Dopo aver passato in rassegna la suddetta disciplina, l’A. si sofferma sul cantiere delle riforme attualmente in atto sui versanti nazionale, locale e per certi versi anche eurounitario, mettendo in luce come esso possa costituire l’occasione per ragionare sull’opportunità di un cambio di rotta, ovvero della costituzione di un osservatorio provinciale sui diritti delle persone disabili sulla falsariga di quelli tirolese e altoatesino.
Abstract: The essay reconstructs the complex regulations in force in Trentino regarding the protection of persons with disabilities. It focuses particularly on the reasons why the province has not established a body to monitor the respective 2006 UN Convention (as has been done in Tyrol and South Tyrol, i.e. in the other territories of the Euregio). Having reviewed these regulations, the author turns to the reforms currently underway at the national, local and, in some respects, EU level, highlighting how this could be an opportunity to consider a change of course, namely the establishment of a provincial observatory on the rights of persons with disabilities along the lines of those in Tyrol and South Tyrol.
Zusammenfassung: Der Aufsatz rekonstruiert die (komplexen) geltenden Vorschriften im Trentino zum Schutz von Menschen mit Behinderungen und konzentriert sich dabei insbesondere auf die Gründe, warum auf Landesebene keine Stelle zur Überwachung der entsprechenden UN-Konvention von 2006 eingerichtet wurde (wie dies hingegen in Tirol und Südtirol, also in den anderen Ländern der Euregio, geschehen ist). Nach einer Übersicht über die oben genannten Vorschriften befasst sich der Autor mit den derzeitigen Reformen auf nationaler, lokaler und in gewisser Weise auch auf EU-Ebene und hebt hervor, dass dies eine Gelegenheit sein könnte, über die Zweckmäßigkeit eines Kurswechsels nachzudenken, d. h. über die Einrichtung einer Landesbeobachtungsstelle für die Rechte von Menschen mit Behinderungen nach dem Vorbild derjenigen in Tirol und Südtirol.
