L’accesso “preferenziale” al lavoro agile tra disabilità e condizione di fragilità: analogie e differenze
Sinossi: Due recenti pronunce di merito – la prima del Tribunale di Roma, l’altra del Tribunale di Trieste – offrono l’occasione di comparare le nozioni di fragilità e di disabilità, mettendo altresì a confronto le diverse tutele previste per il prestatore di lavoro che ne è affetto. Utilizzando quale chiave di lettura l’istituto del lavoro agile, l’Autore mette quindi in luce come dietro le due condizioni di disabilità e fragilità si nasconda un diverso bilanciamento tra tutela della salute, diritto al lavoro e libertà di organizzazione dell’impresa.
Abstract: Two recent judgements – the first by the Tribunal of Rome, the other by the Tribunal of Trieste – offer the opportunity to compare the notions of frailty and disability, as well as the different protections that derive from them for employees suffering from such conditions. Using the legal institution of agile working as a key to understanding, the Author thus highlights how behind the two conditions of disability and frailty lies a different balance between health protection, the right to work and the freedom to conduct a business.
