Die Umsetzung des Art. 33 UN-BRK in Bund und Ländern in Österreich – L’attuazione dell’art. 33 della Convenzione delle Nazioni Unite sui diritti delle persone con disabilità a livello federale e regionale in Austria
Zusammenfassung: Art. 33 der UN-Behindertenrechtskonvention (UN-BRK) verpflichtet die Vertragsstaaten zur Einrichtung nationaler Umsetzungs- und Überwachungsstrukturen. Die Bestimmung sieht die Benennung von Anlaufstellen und Koordinierungsmechanismen, die Einrichtung unabhängiger Monitoringstellen nach Maßgabe der Pariser Prinzipien sowie die umfassende Einbindung der Zivilgesellschaft, insbesondere von Menschen mit Behinderungen und ihren Organisationen, vor. Der Beitrag analysiert die Umsetzung des Art. 33 UN-BRK in Österreich auf Bundes- und Landesebene. Im Fokus stehen die einfachgesetzliche Ausgestaltung im Bundes-Behindertengesetz, die institutionelle Entwicklung des Bundes-Monitoringausschusses sowie die Koordinierungs- und Partizipationsstrukturen auf Bundesebene. Ergänzend werden die landesrechtlichen Umsetzungsmodelle dargestellt und am Beispiel des Landes Tirol exemplarisch vertieft. Der Beitrag zeigt, dass auf Bundesebene alle Strukturkomponenten des Art. 33 UN-BRK gesetzlich verankert sind, während sich auf Landesebene unterschiedliche rechtliche und institutionelle Ausgestaltungen der Monitoringmechanismen feststellen lassen.
Abstract: Article 33 of the United Nations Convention on the Rights of Persons with Disabilities obliges States Parties to establish national implementation and monitoring structures. The provision provides for the designation of contact points and coordination mechanisms, the establishment of independent monitoring bodies in accordance with the Paris Principles, and the broad involvement of civil society, in particular persons with disabilities and their organisations. This paper analyses the implementation of Article 33 of the United Nations Convention on the Rights of Persons with Disabilities in Austria at federal and regional level. The focus is on the structure of the federal disability law, the institutional development of the federal monitoring committee, and coordination and participation structures (again at federal level). The implementation models provided for in regional legislation are also presented and examined in detail using the example of the province of Tyrol. The article shows that at the federal level, all the structural components of Article 33 of the UN Convention on the Rights of Persons with Disabilities are enshrined in law, while at the regional level there are different legal and institutional configurations of monitoring mechanisms.
Sinossi: L’art. 33 della Convenzione delle Nazioni Unite sui diritti delle persone con disabilità obbliga gli Stati contraenti a istituire strutture nazionali di attuazione e monitoraggio. La disposizione prevede la designazione di punti di contatto e meccanismi di coordinamento, l’istituzione di organismi di monitoraggio indipendenti in conformità con i Principi di Parigi e un ampio coinvolgimento della società civile, in particolare delle persone con disabilità e delle loro organizzazioni. Il contributo analizza l’attuazione dell’art. 33 della Convenzione delle Nazioni Unite sui diritti delle persone con disabilità in Austria a livello federale e regionale. L’attenzione si concentra sulla struttura della legge federale sui disabili, sullo sviluppo istituzionale del comitato federale di monitoraggio e sulle strutture di coordinamento e partecipazione (sempre a livello federale). Vengono inoltre presentati i modelli di attuazione previsti dalla legislazione regionale e approfonditi con l’esempio del Land Tirolo. Il contributo dimostra che a livello federale tutte le componenti strutturali dell’art. 33 della Convenzione delle Nazioni Unite sui diritti delle persone con disabilità sono sancite dalla legge, mentre a livello regionale si riscontrano diverse configurazioni giuridiche e istituzionali dei meccanismi di monitoraggio.
